Legal Requirements
The legal requirement for LEV testing is that an examination of the system should be performed at least every 14 months. The employer has a responsibility and duty of care to their employees to protect their health from any airborne contaminates. It is vital that the LEV systems are regularly inspected and that they are in full working order and to the correct standard. There have been many cases of injury due to negligence.

“In 2004, more than 500 construction workers lost their lives to lung cancer and even more were suffering from silicosis as a result of inhaling a dangerous substance called Respirable Crystalline Silica, (known as ‘silica dust’ or ‘RCS’)”
This highlights the importance of LEV testing, effective system installation and maintaining a high functioning standard.
Regulation 9 of the Control of Substances Hazardous to Health Act states
"Every employer who provides any control measure to prevent exposure of an employee to a substance hazardous to health, shall ensure that it is maintained in an efficient state, in efficient working order and in good repair in addition, where engineering controls are provided, the employer shall ensure that thorough examinations and tests are carried out and a suitable record of these be kept and made available for at least 5 years."
